Land Registry: Is your home registered as belonging to you?

Most people have heard of the term Registered Land but what does it mean?

If you purchased your property before December 1987 your property is probably not registered at the Land Registry and you may want to consider a voluntary application to register your land. Registration gives peace of mind, proves your ownership and protects against any claims on your land.

Land Registration is now compulsory when a property is sold. The compulsory registration date for the Furness area was 1st December 1987. If you bought your property after that date it should be registered. Just over 60 per cent of land in England and Wales is currently registered at the Land Registry.

Registration of property means the Land Registry has a record of who owns the property and other relevant information. On completion of registration you will receive a unique title number for your property.

Exchange of Contracts

A commonly used term when buying or selling a house is "exchange of contracts" but what does this actually mean?

Exchange of contracts is possibly the most critical stage in the house selling process, as until this point all steps have been "subject to contract" and either the sellers or the buyers have been free to withdraw.

When contracts have been "exchanged" then both parties become legally bound and there can be no turning back. This is also the stage when a "completion" or "moving" date is set and definite arrangements can now be made with regard to removals etc.

Completion basically involves the buyers’ conveyancer handing over the required sum of money to the sellers’ conveyancer, in return for the deeds and most importantly to the buyers, confirmation that they can collect their keys from the estate agent and move into their new home and start unpacking all those boxes.
